Terms of Service

The Gameset is available only to licensed Illinois video gaming establishments and licensed Terminal Operators, acting through an authorized representative who is at least 21 years old. By using the service you represent that you are authorized to act for the business you register and that its licenses are valid and in good standing.

The Gameset is an anonymized board where establishments post profiles of their gaming floor and Terminal Operators spend prepaid Listing tokens to unlock one and submit structured, non-monetary offers for that floor. Operators compete on service — games, cabinet age, refresh cadence, coin-op amenities, and responsiveness — never on money or on the revenue split.

The Gameset is a neutral venue. We are not a party to, and do not broker, guarantee, or enforce, any use agreement or other arrangement that an establishment and an Operator may enter into off the platform.

Illinois law fixes the split between establishments and Terminal Operators — the after-tax split is fixed 50/50 by statute (230 ILCS 40/25(c)) — and prohibits inducements of value. The Gameset is built to that constraint: no price, split, bonus, or other monetary field exists on an offer, and offers are limited to the permitted, non-monetary dimensions defined under Rule 1800.350(b).

You agree not to use The Gameset to solicit, offer, or exchange any payment, credit, or thing of value as an inducement, or to circumvent the platform’s non-monetary structure.

• Terminal Operators purchase prepaid Listing tokens in any quantity. Listing tokens are what we sell: access to Listing data.
• Listing-token purchases are non-refundable, made before any Listing is unlocked, and independent of any Listing or outcome.
• Unlocking a Listing spends that Listing's flat Listing-token fee and grants the right to submit an offer. Spent Listing tokens are not returned for any reason, including a Listing closing or being awarded to another Operator.
• Neither Listing-token purchases nor unlocks are a commission, success fee, or payment made in connection with any use agreement.
• Payments are processed by our third-party payment provider. You agree to their terms as well as ours.

You are responsible for the activity on your account and for keeping your sign-in access secure. We may require identity or license verification before enabling certain features, and we may suspend or terminate accounts that fail verification, provide false information, or violate these Terms.

You agree not to:

• List or represent a business you are not authorized to act for.
• Attempt to de-anonymize Listings or identify a Location from board data.
• Submit false, misleading, or unlawful information.
• Interfere with, scrape, overload, or attempt to breach the service.
• Use the service for any purpose that violates gaming law or these Terms.

Where the service displays public Illinois Gaming Board data, that data is provided by the State and is offered on an “as is” basis; we do not warrant its accuracy, completeness, or timeliness, and it is not an offer or a recommendation.

The Gameset provides tools and information, not legal, financial, tax, or regulatory advice. You are responsible for your own compliance with all applicable laws and for any decision you make using the service. Consult your own advisors before entering into any agreement.

The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the fullest extent permitted by law, The Gameset LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or relating to your use of the service. Our total liability for any claim relating to the service will not exceed the access fees you paid to us in the twelve months before the claim.

You agree to indemnify and hold harmless The Gameset LLC and its affiliates from any claims, losses, and expenses arising out of your use of the service, your content, or your violation of these Terms or of applicable law.

These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. The exclusive venue for any dispute is the state and federal courts located in Illinois.

We may update these Terms from time to time. When we make material changes we will revise the effective date above. Your continued use of The Gameset after an update means you accept the revised Terms.
